Terms of sale

Terms of ordering, sale and complaints for chrysanthemum cuttings. Sending an enquiry through the form means you accept them. This translation is for information only; the Polish version is binding.

  1. Orders may be placed by post, by e-mail or in person, stating the number of cuttings, the varieties and the delivery date.
  2. The seller confirms acceptance of the order in writing.
  3. Receiving the order confirmation without raising objections to it constitutes acceptance of the terms of sale.
  4. Order confirmations are sent by e-mail only. Please include your e-mail address in the order.
  5. Availability of new varieties may change because the number of mother plants is limited.
  6. If an ordered variety is unavailable, we will offer you a similar variety for approval.
  7. Please send any changes or additions to the order by e-mail.
  8. After receiving the confirmation, the buyer must pay a deposit of 20% of the order value within 14 days, to the seller’s bank account or by postal order to the seller’s address.
  9. If the buyer cancels the ordered goods less than 6 weeks before the collection date, the seller retains the deposit.
  10. The buyer must collect the cuttings on the date specified in the order, with a tolerance of ±1 week. Owing to the nature of the goods, the order is considered fulfilled on time if the plants leave the seller’s premises no earlier than 7 days before and no later than 7 days after the agreed date. The seller reserves the right to fulfil the order in batches.
  11. Deliveries are made from the seller’s premises using the buyer’s own transport or a forwarding company, within a maximum of 2 working days. The seller is not liable for damage caused by the carrier.
  12. All prices are net prices and do not include VAT (8%) or transport costs. The minimum order per variety is 50 cuttings and multiples thereof; the minimum total order for courier shipment is 400 cuttings. Payment in cash only on collection of the cuttings.
  13. When ordering for collection in person, please state the number of boxes needed.
  14. Complaints concerning the size, quality and quantity of the purchased cuttings must be made within 2 days, in person, in writing or by phone.
  15. Any advice given by the seller is given in good faith and out of care for the customer. However, as the seller has no control over how it is applied, the seller accepts no liability for its implementation or consequences.
  16. For all justified complaints made on time, the seller’s financial liability is limited to the value of the cuttings.
  17. Protected varieties: if the order includes varieties under legal protection, i.e. entered in or filed for the register of exclusive rights kept by COBORU (Research Centre for Cultivar Testing) in Słupia Wielka near Poznań, the purchased cuttings of these varieties may be used solely for the production of commercial plants and sold as such. Further propagation of the purchased plants is prohibited by law. The grower allows the breeder’s representatives to inspect the crop to check compliance with the terms of the agreement.
  18. The goods supplied remain the property of the seller until the invoice has been paid in full. This reservation also applies to plants at an advanced stage of growth. In the event of late payment, the seller may recover the amount due through legal proceedings before the court in Gryfino.
